Umbra Hosting, LLC reserves the right to change this Policy any time, so please, check this page when in doubt. Umbra Hosting, LLC strives to provide the best possible service to all our customers, but we will not tolerate any unlawful activity or abuse on our servers. We respect freedom of speech and expression unless it is harmful to others. These brief guidelines are imposed to protect you, other Umbra Hosting, LLC customers and us against such harm.
Payment Policies, Fees, Refunds
Full payment is required before any hosting service is rendered, which includes renewals. Payment is through a valid credit card or via PayPal. Prepayment is due at the time of ordering your hosting plan, and then depending on the payment cycle intervals after that.
Umbra Hosting, LLC reserves the right to change prices at any time. Price changes do not effect current Umbra Hosting, LLC clients. The price that you purchased your Umbra Hosting, LLC account at, will remain locked into that pricing, and not effected by future price rises.
Account Cancellation
Umbra Hosting, LLC is proud to offer a 15 day no-risk money back guarantee. If you are not satisfied with our service, and wish to cancel, we will issue you a full refund of your purchase price, less transaction fees occurred in processing your payment. This money back policy applies to Shared, Reseller and VPS accounts. It does NOT apply to dedicated server packages.
Additionally, we offer pro-rated refunds if you choose to cancel your plan before the duration of your hosting plan has expired. If an account is canceled by Umbra Hosting, LLC due to a violation of our Terms, there will be no refund issued. All monetary transactions are in United States dollars only. Indemnification Policy
You agree to use all Umbra Hosting, LLC services and facilities at your own risk. Umbra Hosting, LLC specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Umbra Hosting, LLC be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Umbra Hosting, LLC harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Umbra Hosting, LLC, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.
Server abuse policy
If we determine that any site on any of our servers is using too many server resources and therefore abusing the server, we have the right to suspend that domain without any notice. It is then up to you to contact us and formulate a plan on how to modify the content within your hosting account so that it will not abuse the server upon un-suspension. We are quick to suspend any domain that abuses the server's resources due to the shared nature of the server and the negative impact an abusing hosting account has on other users' accounts hosted on the same server.
Further, accounts on our shared servers with cPanel installed are not to be used as backup accounts for large amounts of data as this will quickly consume the server's resources and cause issues for other accounts hosted on the server. Additionally, no proxy sites of any kind are allowed on any server operated by Umbra Hosting, LLC.
Mass email campaigns
We do not allow mass email marketing campaigns of any kind on our servers, as we do not allow sites of that nature to be hosted within our shared environment. Sites such as "safe lists" and "free email" are also strictly prohibited. We reserve the right to shutdown such sites, that we consider harmful any of our server's performance.
SPAM Policy
Umbra Hosting, LLC is committed to a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either:
-Over the Umbra Hosting, LLC network
-By customers or any other users of the Umbra Hosting, LLC network
-Over ANY network if the message sent advertises or mentions a site hosted on the Umbra Hosting, LLC server
We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any customer disregarding this policy. Sending unsolicited commercial email (also referred to as "spam" or "junk mail"), cross-posting messages to a large number of Usenet groups, posting obscene or threatening messages while using or referring to an Umbra Hosting, LLC email address or web site URL is prohibited. The use of Umbra Hosting, LLC servers as a mail drop for responses to activities described above is also prohibited.
If your domain is involved in spamming activities, and your account is subsequently terminated, then you do not have the right for a refund. This also includes if you have paid for additional services, such as installations of software or IP addresses.

Content Policy
All services provided by Umbra Hosting, LLC may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless Umbra Hosting, LLC from any claims resulting from the use of the service which damages the subscriber or any other party.
Umbra Hosting, LLC does allow adult websites as long as they do not contain illegal material. As long as your site complies with federal laws (such as federal statute 2257), and state laws in Texas, then it should not be an issue. However, we recommend dedicated hosting for sites hosting adult content as sites of that nature become very popular, very fast and could potentially cause an issue on the shared hosting environment. Umbra Hosting, LLC will be the sole arbiter in determining violations of this provision. Sites that promote any illegal activity or present content that may be damaging to Umbra Hosting, LLC servers or any other server on the internet are prohibited from being hosted on our servers.
Backups
Umbra Hosting, LLC makes weekly backups of customer accounts which are less than or equal to one gigabyte in size (1GB). However, no guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only and it is the client's responsibility to maintain local copies of their web content and/or any other information stored on servers operated by Umbra Hosting, LLC. The "Backup Manager" is included as a built-in cPanel feature that is available in every hosting plan offered by Umbra Hosting, LLC so that each client can backup their files.
